I'm not defending it, M@, but theft and copyright infringement (an infringement of the requirements under which one has a right to make a copy of any document they purchase) are entirely different things.

If the companies are that worried about their intellectual property, they only have to ask sites to stop hosting the roms, as many have done in the past on request - just try finding any US Gold, Codemasters, or Ultimate's ZX Spectrum/C64 games.  Despite selling loads of retro compilations, most companies don't bother with crackdowns on rom emulation possibly because it's not worth their time - they already view the pc (emulation) and home console crowd as vastly different markets, even though the current generation of consoles are pretty much just glorified pcs.
