Sugar, Tobacco etc are addictive to everyone and thats why it's illegal. Food in itself isn't addictive and so is legal.
It's only when you have shortages or drugs involved that the Judges have intervened.
Suicide is illegal but overeating doesn't seem to lead to early death as medical technology has proressed so far.
This does bring up the point as to when Dredd segregated the block of fatties why there wasn't some way of medically sucking it out.

Possibly more fun reasons: well inconsistent health laws are not unique to Mega City One.  
 It's easy to police bans on coffee, tea, salt etc but difficult to stop people binging on legal foods

Surely the fatty thing brings a lot of revenue into the city, it attracts competitors, fans, sponsors, they have tournaments and stuff, and I'm sure the judges get to take quite a large chunk of the profits in return for staging all this.

PLus, with 99% unemployment, I guess the more cits have to take their minds off stuff the less trouble they'll get into, so this can only be another good thing for the judges.

Besides, all the fatty stuff gets to be strictly regulated and happen under their supervision (mainly) rather than people just binging at home. Better a select, controllable few than the whole populace, right?
